These Terms & Conditions ("Terms") constitute a legally binding agreement between Adit Goel, operating as EduNova Studio ("we", "us", "our"), an unregistered freelance service business based in Kurukshetra, Haryana, India, and any person ("User", "you", "your") who accesses or uses the website edunova.click (the "Platform") or any associated services.

1. Introduction

1.1. Welcome to EduNova Studio. These Terms govern your access to and use of the Platform, including all content, services, and features offered through it.

1.2. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

1.3. If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.

2. Definitions

2.1. "Account" means the registered profile created by a User to access features of the Platform such as the customer dashboard.

2.2. "Order" means a service request placed by a User through the Platform, confirmed via WhatsApp communication.

2.3. "Services" means the freelance digital services offered by EduNova Studio, including presentation design, PDF editing, copy typing, data entry, web development, digital business card design, and teaching/tutoring.

2.4. "User Content" means any content submitted by Users, including reviews, ratings, and feedback.

2.5. "Applicable Law" means all laws, rules, and regulations of India applicable to the Platform and its operations.

3. Acceptance of Terms

3.1. By creating an Account, placing an Order, or otherwise using the Platform, you confirm your acceptance of these Terms.

3.2. Continued use of the Platform after any modification to these Terms constitutes acceptance of the modified Terms.

3.3. These Terms apply to all visitors, registered Users, and any other persons who access the Platform.

4. Eligibility

4.1. You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872, to independently use the Platform.

4.2. Students and minors may use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

4.3. By using the Platform, you represent that you possess the legal capacity to enter into a binding agreement or are doing so under appropriate supervision.

5. User Accounts

5.1. Certain features of the Platform, such as the customer dashboard for order tracking, require you to create an Account.

5.2. You agree to provide accurate and complete information during registration and to keep it updated.

5.3. You are solely responsible for all activities that occur under your Account.

5.4. We reserve the right to suspend or terminate your Account if any information provided is found to be false or misleading.

6. Account Security

6.1. You are responsible for maintaining the confidentiality of your login credentials.

6.2. You agree to notify us immediately at edunova1125@gmail.com upon becoming aware of any unauthorized use of your Account.

6.3. We shall not be liable for any loss arising from your failure to maintain the security of your credentials.

7. Services

7.1. EduNova Studio offers freelance digital services as described on the Platform. All Services are delivered digitally — no physical products are shipped.

7.2. Service features, scope, pricing, and availability are subject to change. Final scope and pricing for each Order are confirmed manually via WhatsApp before work commences.

7.3. Delivery timelines stated on the Platform are estimates. Actual delivery depends on requirements shared by you and any revisions requested.

8. Orders

8.1. Submitting an order inquiry through the Platform constitutes an offer to engage our services, which is subject to acceptance by us.

8.2. A binding service agreement is formed only upon our confirmation via WhatsApp, confirming the scope, price, and timeline.

8.3. We reserve the right to decline any Order at our discretion, including in cases of unclear requirements, suspected misuse, or unavailability.

9. Pricing and Payment

9.1. All prices displayed on the Platform are in Indian Rupees (INR).

9.2. As EduNova Studio is an unregistered freelance business, GST is not applicable to our services at this time.

9.3. Payment methods accepted include UPI, bank transfer, cash, and other methods confirmed at the time of the Order. No payment gateway is used; all payments are arranged manually.

9.4. We do not store any payment card or banking credentials. Payment details shared over WhatsApp are used solely for manual confirmation.

9.5. Pricing is confirmed before work begins. We shall not be bound by any typographical errors on the Platform; in such cases, the correct price will be communicated to you before proceeding.

10. Intellectual Property

10.1. All original content on the Platform — including text, graphics, logos, and design — is the property of Adit Goel / EduNova Studio.

10.2. Work products created for you as part of a Service Order are delivered to you for your use upon payment. We retain the right to display completed work in our portfolio unless you request otherwise in writing via email to edunova1125@gmail.com or via WhatsApp message to +91 89305 98651, clearly stating the Order ID and your request to exclude the work from our portfolio.

10.3. Nothing in these Terms transfers ownership of the Platform's underlying design, code, or branding to you.

11. User Generated Content

11.1. You may submit reviews, ratings, and feedback ("User Content") through the Platform.

11.2. By submitting User Content, you grant EduNova Studio a non-exclusive, royalty-free license to display and use such content for business and promotional purposes.

11.3. You represent that your User Content is honest, accurate, and does not infringe any third-party rights.

11.4. We reserve the right to remove any User Content that violates these Terms or applicable law.

12. Reviews and Ratings

12.1. Users may post honest reviews and ratings of Services used.

12.2. Reviews must not contain false, defamatory, obscene, or unlawful content.

12.3. We do not endorse and are not responsible for opinions expressed in User reviews.

12.4. We reserve the right to moderate or remove reviews that violate these Terms.

13. Acceptable Use

13.1. You agree to use the Platform only for lawful purposes and in accordance with these Terms.

13.2. You shall not use the Platform in any manner that could damage, disable, or impair it, or interfere with any other party's use of it.

14. Prohibited Activities

14.1. You shall not:

• Violate any applicable Indian law while using the Platform;
• Upload or transmit viruses, malware, or any harmful code;
• Attempt unauthorized access to the Platform's systems or data;
• Engage in fraudulent transactions or misuse of service requests;
• Impersonate any person or misrepresent your identity;
• Scrape, harvest, or collect data from the Platform without authorization;
• Use the Platform to transmit unsolicited advertising or spam.

15. Limitation of Liability

15.1. To the maximum extent permitted under applicable Indian law, EduNova Studio / Adit Goel shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or Services.

15.2. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific Service giving rise to the claim.

15.3. Nothing in these Terms limits liability that cannot be excluded under applicable law, including statutory consumer rights under the Consumer Protection Act, 2019.

16. Disclaimer of Warranties

16.1. The Platform and all Services are provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

16.2. We make reasonable efforts to deliver Services to the agreed quality and timeline, but do not offer any guarantee beyond what is expressly agreed in each Order.

17. Indemnification

17.1. You agree to indemnify and hold harmless Adit Goel / EduNova Studio from any claims, damages, or expenses arising out of your breach of these Terms, violation of applicable law, or infringement of any third-party rights.

18. Force Majeure

18.1. We shall not be liable for any failure or delay in delivery of Services caused by events beyond our reasonable control, including natural disasters, internet/power outages, illness, governmental action, or failure of third-party platforms.

19. Termination

19.1. We may suspend or terminate your access to the Platform at any time for breach of these Terms or conduct harmful to the Platform or other users.

19.2. Upon termination, your right to use the Platform ceases. Sections 10, 15, 17, and 22 survive termination.

20. Privacy

20.1. Your use of the Platform is governed by our Privacy Policy, available at /legal/privacy, which describes how we collect, use, and protect your personal data.

21. Third-Party Links

21.1. The Platform may contain links to third-party websites (such as WhatsApp, Instagram, or payment references). We are not responsible for the content, privacy policies, or practices of any third-party websites.

22. Governing Law and Jurisdiction

22.1. These Terms shall be governed by the laws of India.

22.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts at Kurukshetra, Haryana, India.

22.3. Before initiating formal proceedings, both parties agree to attempt resolution in good faith via written communication within 15 days of written notice of the dispute.

22.4. Nothing in this section restricts your statutory right to approach the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

26. Miscellaneous

26.1. These Terms, together with the Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and EduNova Studio regarding use of the Platform.

26.2. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force.

26.3. Our failure to enforce any right under these Terms shall not constitute a waiver of that right.

26.4. We may assign our rights and obligations under these Terms in connection with a business transfer. You may not assign your rights without our prior written consent.

26.5. You consent to receive communications from us electronically via email, WhatsApp, or other digital means, and agree that such communications satisfy any legal requirement for written notice.
